E&O quote comparison checklist for agents

Type the terms from two or three E&O quotes and see which terms differ, which answers are missing and what to ask your broker. The twelve terms are the ones the 16 E&O providers we cover publish on their program pages and policy forms.

The twelve terms to compare

Use these as your checklist when you read a quote. The last column shows how many of the 16 E&O providers we cover publish the term, so you know what is normal to ask for in writing.

Limits per claim and aggregateThe most the policy pays for one claim, and the most it pays for all claims in the policy year. A shared aggregate across many agents can run out before your claim.13 of 16
DeductibleWhat you pay on each claim before the insurer pays. Some deductibles apply to damages only, others to defense costs too.13 of 16
Defense costs inside or outside the limitInside the limit means legal fees use up the same money that pays a settlement. Outside means defense is paid in addition to the limit.8 of 16 (1 more says it varies by program)

Consent to settle and hammer clauseWhether the insurer needs your consent to settle. A hammer clause limits what the insurer pays if you refuse a settlement it recommends.7 of 16
Retroactive date or full prior actsClaims-made E&O only covers work done after the retroactive date. Full prior acts covers older work too. Keeping your retro date when you switch insurers avoids a gap.14 of 16
Claims-made formA claims-made policy covers claims made while it is in force. Claims-made and reported also requires you to report the claim during the policy period.13 of 16
Claims-made and reported at 8 providers and claims-made at 5. None we cover publish an occurrence form.
Extended reporting period (tail)Extra time to report claims after the policy ends, for example when you retire, sell or switch. Check how long it lasts, what it costs and how soon you must buy it.13 of 16
Cancellation and refundHow you or the insurer can cancel, how much notice is given and whether unused premium is refunded pro rata or short rate.9 of 16
Who is coveredWhether the agency, owners, employees, independent contractors and subproducers are all insureds under the policy.14 of 16
Regulatory and disciplinary proceedingsWhether the policy pays defense costs when a state insurance department or licensing board takes action against you.5 of 16
Cyber and privacyWhether a data breach, privacy claim or social engineering loss is covered, sublimited or excluded. Many E&O forms leave this to a separate cyber policy.10 of 16
Other exclusionsWhat the policy will not cover, such as carrier insolvency, commingled funds, fraud or certain products. Read these against the business you actually write.11 of 16

What each provider publishes

Vendors with the most published facts come first, then those with a verified identity, published prices and more years in business. Paid placement never changes that order.

Published means the provider states the term on its own program page, application or specimen form. Not published means you need to ask for it. This is a count of what is public, not a rating of the coverage.

How this tool works

The term list comes from the policy terms E&O providers publish for insurance agents: limits, deductibles, defense costs, consent to settle, prior acts, the claims-made form, extended reporting, cancellation, who is insured and the main exclusions. Each explanation is a plain summary, not policy wording.

The comparison only uses what you type. A term is flagged as missing when a quote leaves it out or you mark that the quote doesn't say. A term differs when the quotes give different answers. We don't say which quote is better, because that depends on your agency and the full policy.
