Agent E&O covers your defense and any settlement when a client says a mistake you made cost them money. American Agents Alliance is a trade association that sponsors a group E&O program for its members, insured by Markel and run by CalSurance.

It covers life, health, annuity and P&C agents, with a separate track for new agencies.

Our take

This is a strong pick for a small agency that wants defense paid outside the limit and cyber coverage built in. The Alliance advertises new agency rates as low as $650 a year but names no limit or deductible for that figure. Budget for the dues too, which add $50 or more every month.

Read the settlement clause before you sign. If you turn down a settlement Markel recommends, it stops defending you.

Set by how long you've had unbroken agent E&O with proof, or an unbroken agent contract with an insurer. The retroactive date is the earliest date of past work covered

Covered back to that date, as long as the coverage or contract had no gap
Tail options
A free 2-year tail if you become disabled, retire or die while the program continues. Or buy 3 years at 200%, 5 years at 300% or unlimited time at 400% of your last yearly premium, within 60 days

Claims-made means the policy in force when the claim is made pays it. Keep proof of your past E&O with no gaps, since it sets how far back you're covered.

Consent to settle and exclusions

Markel won't settle without your written consent. If you refuse, Markel stops defending. It then pays no more than the amount the claim could have settled for

  • Claims you reported to an earlier insurer
  • Fraud, though defense continues until a court rules
  • Mixing or taking client funds
  • Work as an actuary, accountant, lawyer, appraiser or third-party administrator
  • Placing coverage you aren't licensed for, except allowed surplus lines placements
  • Insurer insolvency, unless the insurer was rated B+ or better by AM Best when you placed it
  • Self-funded plans, MEWAs and VEBAs
  • Unauthorized securities work and promises on variable product rates
